Daily fantasy sports exploded onto the gaming scene in the early 2010s
The premise was simple: instead of selecting a roster of players to compete over a season, you select a roster of players daily. This new form of fantasy sports captivated players and has evolved into a multi-billion dollar industry. But is DFS legal?
In the United States, some operators took the position that the Unlawful Internet Gaming Enforcement Act provided an exemption allowing them to offer Daily Fantasy Sports. They also took the position that playing Daily Fantasy Sports is a game of skill. Presently, DFS is allowed in some states and not others. It is licensed in some states and not others.
In Canada there is no Unlawful Internet Gaming Enforcement Act and the way we determine what is a “game of skill” is different. If you’re a daily fantasy sports operator, software provider, or affiliate, we should chat. We’d like to learn about your business model and review how it fits in with Canadian gaming laws.
