Overview:
Following an investigation monitoring whether registered suppliers were providing content to unregulated operators, the AGCO found that games created by Relax Gaming Limited and  Arrise Solutions Limited were available on unregulated gambling websites accessible to Ontario players. Upon notification of the penalties by AGCO investigators, Relax Gaming Limited and Arrise Solutions Limited cooperated fully with the investigation and took prompt action to restrict Ontario player access to its games on the unregulated platforms.

AGCO issued a Notice of Proposed Order to temporarily suspend PointsBet Canada's iGaming registration, alleging that the operator did not properly monitor, detect, document or report suspicious betting patterns related to the 2024 Jontay Porter insider betting scheme. PointsBet had initially denied offering bets on Porter, but eighteen months later, confirmed it had done so. The AGCO found these wagers showed clear indications of suspicious activity that should have been detected and reported at the time.

FINTRAC's compliance review found SIGA failed to submit 4 required suspicious transaction reports and, in 3 other instances, submitted STRs without the required ML/TF indicators. SIGA also had inadequate policies and procedures for the ongoing monitoring of high-risk and extremely high-risk patrons, failing to properly assess risk for 41 out of 100 patrons reviewed. SIGA contests both the alleged violations and the penalty, maintaining that no identified criminal activity occurred at its properties, and has announced an appeal to Canadian Federal Court.

AGCO found the casino permitted approximately 400 attendees onto active gaming floors for an impromptu after-party in the pre-dawn hours following an EDM event on September 27, 2024, without conducting the required risk assessment or notifying the regulator. The event was marked by widespread intoxication, disorderly behaviour, and numerous criminal and medical incidents, including alleged assaults, drug overdoses, and acts of public indecency. The security and safety lapses compromised patron and operational integrity standards.

AGCO launched an investigation after a player complained that more than $8,500 in winnings had been confiscated by Casino Days. The investigation reviewed a “welcome bonus” of up to $2,000 that required players to wager a minimum of $20 per bet and complete all wagering requirements within seven days. AGCO analysis showed the average player would first lose $3,640 trying to earn the $2,000 bonus. Certain terms of the bonus offer were also buried behind multiple links, making them difficult to find.

In March 2024, the Ontario Provincial Police Investigation and Enforcement Bureau (IEB), embedded within the AGCO, laid charges against five individuals following an investigation into alleged collusion between two table games dealers at Great Canadian Casino Resort Toronto and a group of casino patrons. AGCO's subsequent compliance review confirmed the dealers engaged in a cheat scheme on multiple occasions, generating nearly $20,000 in illicit winnings in less than one week. Surveillance and pit staff failed to detect the scheme. This was noted as Great Canadian Casino Resort Toronto's second recent incident involving allegations of a cheat-at-play and dealer collusion.

AGCO determined that BetMGM Canada engaged marketing affiliates at public events that offered cash payments to individuals in return for opening accounts and making deposits. In January 2024, BetMGM representatives attended the National Franchise Show, offering $100 cash per sign-up. A second incident involved affiliate Above the Street, which resulted in 377 sign-ups and $127,180 in commissions, and affiliate Maple Leaf Marketing, which generated 94 sign-ups. Ontario's regulated igaming rules ban such inducement activations in public advertising and marketing to protect against predatory growth tactics.

Surveillance confirmed the patron left with casino chips without playing. Despite the patron being previously flagged as "high risk," the casino failed to notify the AGCO and on-site police as required, and took no steps to verify the source of funds.

Despite this, no interventions were provided. Additionally, the operator deposited credits totalling $35,500 and offered free sporting event tickets to the player after the player had withdrawn direct marketing consent.

Among the first enforcement actions taken by the AGCO in Ontario's newly launched iGaming market (which opened in April 2022), the regulator served both BetMGM Canada and PointsBet Canada with Notices of Monetary Penalty for prohibited public advertising of gambling inducements and bonuses. BetMGM's violations related to specific social media posts promoting a contest and a bonus offer. PointsBet violated the inducement advertising standard.
