When Ontario opened its online gambling market to private operators in 2022, many in the industry hoped that it would start a wave of regulated regimes across Canada. Two years later, Alberta has taken steps to follow suit, announcing in June that it would launch its own regulated online gambling market.

Void in Quebec. No, that’s not the latest tourism campaign of la belle province. “Void in Quebec” is a phrase that is synonymous with Canadian sweepstakes contests. Or at least it was synonymous with Canadian sweepstakes contests until recent legislative changes in Quebec removed most of the sweepstakes contest requirements for contests open to Quebec residents.

On April 4, 2023, Ontario’s regulated internet gaming (iGaming) market turned one. To celebrate, the Canadian Gaming Association threw a birthday party. A one-year-old, much like the Ontario iGaming market, is an amorphous blob of unfulfilled potential. And much like a birthday party for a one-year-old, the party is really about the parents and the community around the parents that helped the child survive and grow for its first year, like friends, family, lobbyists, and multi-national gaming organizations.

There’s a lot at stake, but odds are the federal government will finally legalize single-event sports wagering, as the Safe and Regulated Sports Betting Act (Bill C-218) waits to clear the Senate. If it does, it will be up to the provinces to figure out the shape betting in Canada will take, and choose whether to implement a competitive gaming regime or retain their monopolistic hold on gambling.
On the Hunt for Canadian Gaming Bigfoot

In the Canadian gaming field, we have our own Bigfoot. Part of Canadian gaming folklore, this “Canadian Gaming Bigfoot” is a game that appears to be quasi-gambling but is actually a game of skill. There have been many claims of Canadian Gaming Bigfoot sightings, but these claims are either untested (e.g., daily fantasy sports, penny auctions), or upon closer inspection and a review of the evidence (i.e., by a Canadian court), determined by courts to be either a game of chance or mixed chance of skill (i.e., not Canadian Gaming Bigfoot).

Government control over gambling in Canada is exerted at the federal and provincial levels through legislation and enforcement of legislation. Offshore remote gambling presents jurisdictional and enforcement challenges to government control over gambling. These jurisdictional and enforcement challenges have led to offshore remote gambling operators accepting players located in Canada without fear of repercussion from Canadian authorities. As an alternative to criminal and quasi-criminal control over offshore remote gambling, which has not been an effective deterrent, the Quebec government is attempting to control offshore remote gambling by blacklisting and blocking unauthorized remote gambling websites. This exercise of network sovereignty is unprecedented in Canada.
